zoning

Every Virginia Board of Supervisors has the legal authority RIGHT NOW under Va. Code sections 15.2-2280 and 15.2-2286 to require Special Use Permits (SPEX) for data centers. Loudoun voted 7-2 on March 18, 2025 to end by-right data center approvals. Prince William voted 8-0 against a 2,000-acre proposal. Shenandoah had the authority before Takanock manufactured a vesting letter. The failure to use it is political — not legal.

water

Data centers are the fastest-growing industrial water users in America. Northern Virginia alone consumed 2 billion gallons in 2023 — an 86% increase since 2019. The Potomac River, drinking water for 5 million people, has 12% of its summer flow consumed by data centers. Amazon paid $20.5M in 2026 after contaminating Oregon wells. Illinois passed emergency legislation to protect the Mahomet Aquifer. Virginia has no equivalent protection.

National Patterns

Two documented cases — Temple, TX and Caroline County, VA — show the same playbook: officials sign NDAs with data center companies, vote on the deals, then can't produce the documents when constituents ask. Tap to read the full investigation.

Community FOIA Fund

Public records aren't free — filing fees, copying costs, and staff time add up fast for counties to produce what we request. Chip in to help fund records requests, research, and the work of keeping this page updated. Contributions support CaseLock's ongoing public-records work generally — they are not tied to any single request, and we can't guarantee any specific document will be obtained. Contributions are not tax-deductible.
