Amazon Data Services, Inc. (ADS) was fined $72,067.80 by the Virginia Department of Environmental Quality (DEQ) for violating three conditions of its minor New Source Permit (mNSR) at the Cosner Tech Campus in Spotsylvania County. The permit, issued October 30, 2024, authorizes 186 non-emergency and 15 emergency diesel generators. VIOLATION 1 — NITROGEN OXIDE EMISSIONS (May 31, 2025): During commissioning activities as part of the permitted Integration Operational Period (IOP), a power outage triggered the start of non-emergency diesel generators. Each generator reached 572°F but the Selective Catalytic Reduction (SCR) system malfunctioned. DEQ found that ADS exceeded the permitted hourly nitrogen oxide (NOx) emission limits. Amazon self-reported the violation to DEQ within the permit notification window. VIOLATION 2 — OPACITY EXCEEDANCE (December 2, 2025): Stack emissions testing showed six-minute average opacities during Visual Emission Evaluations exceeded the required 5% limit. Most advanced and active data center campus in the regional corridor as of June 2026. HEALTH CONTEXT (sourced, peer-reviewed): • Per a September 2025 study in ScienceDirect: nitrogen oxide and opacity pollutants increase rates of respiratory diseases and cardiovascular conditions, and elevate cancer risks among nearby communities. • Per a 2025 model from arxiv.com: U.S. data centers in 2030 could cause approximately 600,000 asthma symptom cases and 1,300 premature deaths annually. REGULATORY GAP: DEQ issues permits but relies primarily on self-reporting. This fine only occurred because Amazon self-reported the violation. The 186 non-emergency generators authorized at this single campus represent a significant diesel combustion source adjacent to residential areas. No independent air quality monitoring is required or in place.
