Virginia State Corporation Commission Commissioner Kelsey Bagot was formerly employed by NextEra Energy — the company now building the $1.63 billion MARL transmission line into Loudoun County. She promised recusal from NextEra cases at her January 2024 confirmation. She was subsequently named in a Dominion rate case in 2025. The SCC approves all Dominion rate increases and transmission projects affecting every Virginia ratepayer.

Every Virginia Board of Supervisors has the legal authority RIGHT NOW under Va. Code sections 15.2-2280 and 15.2-2286 to require Special Use Permits (SPEX) for data centers. Loudoun voted 7-2 on March 18, 2025 to end by-right data center approvals. Prince William voted 8-0 against a 2,000-acre proposal. Shenandoah had the authority before Takanock manufactured a vesting letter. The failure to use it is political — not legal.

Data centers are the fastest-growing industrial water users in America. Northern Virginia alone consumed 2 billion gallons in 2023 — an 86% increase since 2019. The Potomac River, drinking water for 5 million people, has 12% of its summer flow consumed by data centers. Amazon paid $20.5M in 2026 after contaminating Oregon wells. Illinois passed emergency legislation to protect the Mahomet Aquifer. Virginia has no equivalent protection.
